In Part 3 of this 4-part strand, we will review decisions and legal guidance demonstrating the potential outcomes when local educational agencies do not comply with the procedural and substantive requirements of the IDEA (addressed in Parts 1 and 2 of the strand) and when parents and school districts cannot agree on what constitutes a FAPE. We will review the applicable laws and regulations in the context of hearing decisions and case law highlighting the practices and procedures that districts can implement to prevent or mitigate against unfavorable outcomes.
